Introduction
This working paper for the FAiR (Finding Agreement in Return) project focuses on clarifying key concepts essential for enhancing return and readmission policies in Europe. The central idea is that legitimacy is crucial for making these policies more effective and for broadening the alternatives available to those who cannot be returned. The paper aims to ensure precise communication among researchers by defining terms like legitimacy, return migration, enforced return, and alternatives to return. This clarity will help in aligning the research, facilitating dialogue with stakeholders, and ensuring that the policies are applied consistently. The paper is divided into sections that explore the state’s power in enforcing returns, the forms of alternatives to return, the role of legitimacy in the policy cycle, and the ethical challenges in return migration. By addressing these areas, the paper aims to support the FAiR project’s objectives and contribute to more sustainable return policies.
